These Terms of Use ("Terms") govern your access to and use of the Cryptara Conquest mobile application and related services (together, the "Service"), operated by IntoTheVerse Inc ("IntoTheVerse", "we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into a binding contract. You may not use the Service if you are located in, or are a resident of, any jurisdiction where use of the Service or of blockchain-based digital assets is prohibited, or where you are subject to sanctions or trade restrictions.

2. The Service

Cryptara Conquest is a blockchain-based game on the Solana network. The Service may let you connect a self-custodial Solana wallet; mint, own, trade, reincarnate, and reforge in-game items represented as on-chain assets ("NFTs"), including Guardians and Weapons; acquire and spend in-game items and currencies using digital tokens (including SOL, MEW, and SKR); and record progress and scores on-chain and via our backend. We may add, change, suspend, or remove features at any time.

3. Your wallet and self-custody

The Service is non-custodial. You connect your own wallet through the Solana Mobile Wallet Adapter or supported equivalents. We never take custody of, control, or store your private keys, seed phrase, or funds. You are solely responsible for safeguarding your wallet credentials and for all activity that occurs through your wallet. We cannot recover lost keys or reverse transactions.

To enable smooth gameplay, the Service may create a temporary "session key" wallet that you fund with a small amount of SOL to cover network and gameplay transaction costs. You authorize this funding when you confirm it in-app, and remaining balances are refunded to your connected wallet when you log out or when the session is refreshed. You are responsible for reviewing each transaction you approve.

4. Blockchain transactions

All on-chain transactions are irreversible, processed by the Solana network and associated smart contracts, and outside our control. Network fees, congestion, oracle availability, and third-party infrastructure may affect or delay transactions. We are not responsible for failed, delayed, or duplicated transactions, or for any losses arising from them.

5. Digital items, NFTs, and tokens

• In-game items, NFTs, and tokens are not investments, securities, or financial instruments, and we make no representation or guarantee as to their value, liquidity, or future utility.
• Their value may fluctuate or fall to zero. You acquire and hold them at your own risk.
• We do not control secondary markets and are not a party to peer-to-peer transactions between users.
• Pricing shown in the Game for token payments is derived from on-chain rates that can change; the amount actually charged is determined by the smart contract at the time the transaction is processed.

6. Payments

In-app purchases are made with digital tokens via your connected wallet. Because blockchain transactions are irreversible, all purchases are final and non-refundable, except where a refund is required by applicable law or expressly provided in-app (such as session-balance refunds).

7. Acceptable use

You agree not to:

• Use bots, exploits, cheats, automation, or unauthorized third-party software to gain an advantage or disrupt the Service.
• Reverse engineer, tamper with, or attack the Service, its smart contracts, or its infrastructure.
• Use the Service for money laundering, fraud, sanctions evasion, or any unlawful purpose.
• Infringe the rights of others or upload unlawful, harmful, or infringing content (e.g., in a username).

We may suspend or terminate access for conduct that violates these Terms.

8. Intellectual property

The Game, including its art, characters, code, audio, and branding, is owned by IntoTheVerse or its licensors and is protected by intellectual-property laws. Owning an in-game NFT grants you the rights expressly described in-app (if any) but does not transfer ownership of the underlying intellectual property unless we say so in writing.

9. Third-party services

The Service relies on third parties we do not control, including Solana RPC providers, MagicBlock (ephemeral rollups), decentralized storage (e.g., IPFS/Lighthouse), wallet providers, and leaderboard infrastructure. Your use of those services may be subject to their own terms, and we are not responsible for them.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. BLOCKCHAIN AND DIGITAL-ASSET TECHNOLOGY CARRIES INHERENT RISKS, INCLUDING VOLATILITY, SMART-CONTRACT VULNERABILITIES, AND TOTAL LOSS OF VALUE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTOTHEVERSE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TOKENS, NFTS, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US DIRECTLY IN THE 3 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

12. Indemnification

You agree to indemnify and hold IntoTheVerse harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Assets held in your own wallet remain yours.

14. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated Terms with a new "Last updated" date. Your continued use after changes means you accept them.
